Booking.com No Legality to Take Booking

We have read few posts about chargeback attempts and successfuly granted by the banks due to the lack of tick box of asking customers to agree to term and condition of Booking.com 

This vulnerability has been viraled in closed community of travelers and obviously more and more join to do chargeback. 

Despite the numerous attempts by us as partners to ask Booking.com to add this feature that should just add a small amount to their cost, Booking.com has refused to obliged. 

The banks have informed that the lack of the feature is the sole reason why the chargeback is allowed. 

Hence it is Booking.com's mistake that we have to endure. 

We would like to inform all partners that actually this is the breach of Booking.com contract to us as they made us into believe that they have the necessity legality being online accommodation reservation service as their tag in their profile and an e-commerce business when the lack of the tick box made them actually are not allowed to do so. All the payments (prepayment and postpayment including nonrefundable no show and deposits) can be deemed void and fraud as no customers give them consent and authorize them and us to do so. 

This alone is can be consider FRAUD and we all as partners can be liable for that as well as partner in crime. 

The chargeback should be reimburised by Booking.com as they have offered as the prepayment, deposit dan non refund policy that are actually not allowed to be offered by them to do as they have not offering customers to authorize them to do so. 

We are considering to take legal action against Booking.com as we can have chargeback up to all sales to 120 days since today due to their negligence and also the fact they made us into believe that they are eligible to allow us to do prepayment. The cost for chargeback, for litigation in bank arbitration and so on will be huge and this is just because Booking.com refuses to put a "tick box" that actually a necessity in many countries. 

We are looking forward to the feedback of other partners and hopefully since this is the problem for all of us, we should get together and put more pressure on Booking.com to take responsibilities (financially) for all the lost they cost and will cost us due to the lack of this tick box. A class action of all partners will be great. 

Again - please note that this is being viralled already in many sites - Amex and Mastercard have been putting hold for hotel chargeback until April 2018 but Visa is still allowing it and all the travelers are strongly advised to use it in this "chargeback" attempts now in this viral messages. The tricks and tips there are quite specified for Booking.com and Visa International customers so we are expecting more and more cases in the future as 100% attempts are successful and more hopeful travelers will do the same to get "free" accommodations all over the world.

According to the Terms&Conditions of the Booking.com website, if you make a booking via their service, you agree to the T&C which means that you are protected by B.com's T&C and those chargebacks should not have been allowed as the guest agreed to them when making a booking. By making a booking they practically signed a contract with B.com to obey their T&C as well as with the property they booked with to obey their rules and policies.

Obviously we can say whatever we want.

BDC can put whatever they want

Ultimately the rules that merchants have to follow are the rules set up by Visa International and Mastercard and so on as they are the ones that pay. All all of them make a very clear rule that

1) Tick box is required

2) Tick box has to be in the same page as Term and Condition

Otherwise, the transaction is not valid regardless what you and I and BDC said.

They do tick a box to accept T&Cs when booking.
You could also as a customer say for transactions made by card that need a signature that you didn’t sign it.
As far as I know, and that’s what I have been told by B.com, is that guests do sign a valid contract with them and the property so that we should not have problems with charging CCs. I didn’t.

Hi

I do not know if now if BDC has a tick box but when I wrote the post I did not find any tick box. Please print screen the tick box if you can find one. I am a regular customer of BDC as well and I have not tick any box up until last month.

BDC can say whatever they want, and none is honored by Visa International etc and that's why everybody has problem of chargeback. The rules that matter is the paying master - in this case, this is not BDC but Visa International etc. This specific rule is law in UK and several states in US. I even found few travel websites that suggest this trick (you can google it as "friendly fraud). They are specifically mention the flaw in BDC and Visa International.

You are lucky that you did not have problem with charge back. I only had one problem but BDC forums have deleted many posts due to this sensitives issues, some of accommodations in UK and US can get chargeback as much as 6 times a month and BDC cannot do anything about it as they are clearly breaking the rules.

I have had the same problem. I have sent the T&C info along with the chargeback dispute. I have been told dozens of times that without a button that says "We agree to the cancellation policy" or something to that effect, I am out of luck (and over $2,000 so far). I urge booking.com to create a button that the guest MUST click in order to proceed. In doing so, you will save us lost revenue and your commission. One simple button will fix this for us all.

Trust me, lots of hoteliers know about this. It is ridiculous how booking.com will not help solve this by putting an accept terms and conditions checkbox. Choicehotels.com have it, i don't see why booking.com won't have it. nearly majority of no-shows we get, we are always scared to charge, because they'll usually be chargebacks and every chargeback costs us $15. We'll lose it because of this small detail that credit card companies demand we get.
