No tick box in website

Booking.com offers e-commerce business platform to facilitate accommodation but as until today has no tick box required as this e-commerce business. This put all partners accepting payment via VISA liable for chargeback as it is illegal to charge customers without them agreeing to term and conditon. 

I sent more than 5 emails to customer service and our account manager to ask why they do not want to put this but none answered. 

Can any moderator read this one will be able to answer as as partner, we are not happy to pay commission if booking.com cannot adhere their part of contracts?

Booking.com rep just called few hours ago to gladly inform me that they have put the "I agree with .. " but still without tickbox that pax has to tick it. Visa International clearly mentions in their guidance that it has to be a tickbox and pax has to tick it by themselves.

I told them I am not impressed that it takes 7 months to get a response. They informed that they need to liaise again with HQ about it. Told them sarcastically I am impressed with such efficiency for such a big company that takes big amount of commissions to make a tick box and I requested an email for the explanation that they just gave me so I can have black and white record. They have never send any email until now.

Greetings all,

this ridiculous circus goes on and us legit, doing the right thing hosts are continuing to receive illegitimate cashback charges against us.

Researching all this, our conclusions so far is, yes, no surprises normal bank procedures of "whatever pays the most" yes, a crude statement, but one that sums it all up the best.

The millions of paying consumers are given the positive verdict of course, what are a few thousand sellers? we are nothing to them.

As to why B.com does not comply with assistance in this issue? well, simply the same answer...

even though they say, sure, we have our legal team ready with the appropriate paperwork to respond the the cashback charge of the client. here comes the thing, b.com requires the cashback dispute letter from the buyers bank, the banks remain ominous stationing there are privacy issues...

Thanks for the update, hopefully they get that tickbox installed. I'm really glad though that they at least say at te bottom there that you agree with the terms and conditions etc. That already a good barrier.

The GDPR (general data protection regulation) is new legislation that aims to give citizens more control over their personal data. It will impact existing businesses across the EU and even worldwide, as any companies holding or processing EU data will still need to comply. The GDPR was adopted in May 2016 but the enforcement deadline is the 25th of May 2018 so there’s still time for everyone in the hospitality sector to get to work upgrading their data protection process. It is vital that appropriate resources are made available in order to effect the necessary changes. Staff should be trained in GDPR to maintain compliance and all businesses that accept credit card payments should already be compliant with the Payment Card Industry Data Security Standard (PCI DSS).

Booking.com meanwhile still has a very olddated system and if you notice that actually it is not compliant at all with PCI DSS.

Just got a reply for my Cahback dispute, dispite all screenshots, and evidence, OF COURSE the banks rule I am wrong..

Now I have another one and they asking the same thing, its like they dont read or care what you say and again, BDC will say they have the legals to respond to this but WILL NOT GIVE without the initiating cashback banks letter!

And the bank will not give based on privacy, so the circus gos on,

For those that are confused or I did not be clear:

1/ Proof is the legals tying the guest to clicking "I buy it on BDC site

2/ Cashback is at the whim of the guest, what I beleive happens is they do not read the xtras or small print or get annoyed when they realise, but know they can make a cashback whenever they feel like it even if they are wrong, search youtube, its all over the place these cahback scams! even vids on how to do it.

3/ The your proof does not mean anything, as the banks are onside with the paying clients NOT YOU

4/ Seems BDC needs the tick box .. they most likely know but sees it better to ignore thus sweeping under the carpet more headaches and work.. Also onside with the paying guest NOT YOU

Regret that you might keep having this problem as clearly since 2015, Visa International clearly described the requirement of having tickbox and it needs to be ticked by guest. I attached the printscreen of the manual so unless BDC put the tick box then the problem can be solved. Unfortunately also this flaw has been highlighted in many secret tips and tricks for friendly fraud specifically to target BDC hosts.

With new Visa International chargeback new system applied in April 2018, chargeback will be automatically done when customer can just printscreen the page of BDC proofing that BDC does not have tick box.

Worse by tomorrow 25 May, GDPR will be enforced and I have asked BDC whether their system is PCI DSS but they can't answer so I can assume they are not. I am user of BDC as well and until now I do not have any email from BDC informing their privacy policy.

I just lost a $600 chargeback because booking.com is non compliant with Visa USA rules and regulations concerning the check box for terms and conditions. Visa rules clearly state that the terms and conditions must presented to the customer prior to completing the reservation, and this must NOT be done by a hyperlink. They also state that the customer must check a box accepting the terms and conditions. When I called to complain, no one knew what I was talking about and just transferred me to someone else who couldn’t help me. Booking.com really needs to work with Visa on the compliance issues so that their paying customers (hotels and motels) can stop being unfairly charged back due to their lack of compliance. I pay a hefty 15% commission and feel that the site needs to be updated immediately.

It's really under all criticism that they are not compliant with this. The commission is supposed to be a fair fee for handling these things.
