Termination of contract by booking.com - fraud and abuse

My contract on my sole property in Bulgaria has just been terminated by booking.com immediately for "material breach of contract".  The property ID is: 2457739.  No valid reason has been given and I copy my message (to which booking.com refuse to respond) and their email below.  My lawyers will be initiating action against them towards the end of this week.  As I know this has happened to a great many of you in this Community, it is time booking.com were brought to "book" and sued.  A class action would be highly appropriate.  Anyone wishing to join us, please email at *****: Hello, Please explain to me where I have been involved in fraud and abuse and in reference to whom as per email following. Booking.com online hotel reservations Dear Partner, We regret to inform that with this letter we are terminating the Accommodation Agreement and are closing your accommodation on our platform due to a material breach of contract (please refer to article 7.4 of the General Delivery Terms). The following has been detected: you have engaged in unprofessional behavior that resulted in a threat/harassment Due to the seriousness of this breach of contract, your listing on Booking.com will remain closed without a possibility to be reopened. We kindly request you to honour all outstanding reservations you have on our platform prior to the effective termination date, regardless of whether the date of the guests’ departure is before or after the date of termination. In accordance with the terms of the Accommodation Agreement, we also request you to pay any outstanding commission due to Booking.com BV (plus costs, expenses and interest, if applicable). If you have any questions, kindly contact us via your extranet inbox. This is an unmonitored email address, please do not respond directly to this email. This is the sort of spurious reply one receives from booking.com days later:

Dear partner, My name is Maria ***, I tried to call but was not able to reach you. Would like to have spoken to you in regards to your property status that we've requested clarification. According to the information previous given on the email sent *you have engaged in unprofessional behavior that resulted in a threat/harassment and for this reason the property had been closed. Kindly accept our apologies for any inconvenience and please, if you have any further questions, feel free to contact me directly. Kind regards, -- Maria ***

And this is my response: No-one tried to call me - I have no missed calls. I do not behave in an unprofessional manner at any time. Consequently I want to know how I behaved in a manner so unprofessional that my property has been delisted. A SPECIFIC EXPLANATION and detailed description of my so-called "unprofessional" behaviour, not the tripe you are giving me now.

The problem is there is so much to kick and so little time :)

My lawyers are now in touch with Joe *** and Todd *** of booking. com in respect of the ways in which they have broken International law.

I expect this to be fixed fairly quickly.  In 2008, I took the British national newspaper "Daily Express" to court for libel and won.  So, I'm not afraid to go the "extra mile" and booking. com should be aware of that.

Damages won with Daily Express were 300K Sterling.  This is a drop in the ocean for booking. com.  Nonetheless, would they still want to pay that sort of amount to me when they can rectify matters now.

I have to say that this absurd case is intriguing me.

For Booking you're a dangerous man, the one that menace people or rape women but they say to you "We kindly request you to honour all outstanding reservations you have on our platform".

Are they crazy or what?

The only slight give-away of reasoning there is;

"Please recall to your reservations communication from the past month." 

Have you trawled through your guest comms for the last month, reading between the lines, to see if someone may have reported you?

e.g.

Guest: "I want my own olympic-sized pool in the room"

You: "Dear ...I'm terribly sorry but this won't be possible as per the room description given on BDC..."

Guest to BDC: "...I feel extremely harassed and threatened by the host, they refused to provide basic services, were very rude and..."

A little flippant but you get the idea, n'est ce pas...Orrrrrr, you're a raving psychopath!  wink

There is nothing whatever, fluff, to warrant this psychopathic behaviour from booking. com.  There have been no untoward exchanges with guests/potential guests whatever.  It is not impossible that someone has said something to booking. com, but that is the very essence of the situation - Why will booking. com not tell me EXACTLY what they mean as I simply cannot guess (and why should I).  My last communication to them was:

  • So, 9 days on, they have deigned to give me a small clue - it was in reference to a booking which was a no show.  They have a record of all my communications with that party, which obviously contained nothing untoward, so still no reason.

 

  • A phone call elicited the fact that they retain the right to reject partners as they wish and were doing so in my case.  They also retain the right (allegedly, though this is not in their contract with me) to refuse to give me a reason and they do refuse to give me a reason.

 

  • Stupidity in the extreme.

Hi, we are in the same situation and would like to join your battle. They terminated contract accusation from some kind of fraud with no further explanation and totally ruined our high season. They even cancelled and reallocated our reservations just few days before arrival and now they ask as to pay them for that. Is there any update in your situation?
